How to Invest in Property in Dubai Successfully as a Foreigner

Unsure whether investing in Dubai property is a good idea for you? Nobody can predict if a property investment will be worth it, but we can outline crucial rules, regulations and considerations that a foreign investor needs to be aware of.

After all, due diligence is a cornerstone of any UAE property purchase. To kickstart your research, our Dubai property investment guide walks you through the process step-by-step.

Why invest in Dubai property?

Beyond the dynamic surroundings and unique luxury lifestyle, Dubai offers rental yields higher than the UK average. There’s also the prospect of tax-free capital gains and rental income on Dubai properties. But bear in mind, market conditions can change and there can be challenges to any investment.

Steps to investing in Dubai property

1. Define investment goal

What do you want to get out of your Dubai property investment? A clear vision can help you make the best property investment for your goals.

2. Research market & location

Get the inside track by doing your own research and liaising with an estate agent who knows the Dubai property market. Find out too, what each location has to offer in terms of amenities and value.

3. Decide ready property vs off-plan

In Dubai, off-plan purchases comprise a sizeable percentage of the property market, but you can choose to buy a ready property.

4. Finance options

Non-residents can pay upfront or apply for an international mortgage – but overseas buyers may need to supply a 20% or 25% deposit.

5. Budget for all costs

Expect the costs of buying property in Dubai to include legal fees, transfer fee, DLD fees, real estate commission and admin fees.

6. Due diligence

Make sure your agent or developer is registered with the Real Estate Regulatory Agency (RERA), and check the Sales & Purchase Agreement (SPA) carefully.

7. Contract & Registration

Confirm all details, permissions and fees before you sign the contract – developers can take legal action if you back out.

8. Manage & Monetise

Plan how you will monetise your Dubai property and manage it as an overseas buyer.

9. Exit strategy

Will you hold long-term to benefit from steady rental income or the possibility of capital gains? Keep your strategy in mind as you build your portfolio.

What legal & regulatory frameworks should I be aware of?

1. Freehold vs. leasehold rights

The rules on freehold and leasehold permissions will be critical to your Dubai property purchase as a UK citizen. Foreigners can only purchase freehold property in designated zones of Dubai like Downtown Dubai, Dubai Marina and Business Bay, and must apply to the Dubai Land Department for usufruct rights (a long-term lease for up to 99 years) or musataha rights (permission for construction).

2. Designated areas of ownership

Overseas property investors can only invest in areas of Dubai that have been designated by the government. Check that foreigners can purchase property in your chosen locale.

3. Eligibility, Documentation & Age

In Dubai, you must be at least 21 years old to make a real estate investment, and you will need a valid passport. You will also need proof of funds and their source, and when making large or off-plan purchases, the developer, bank or DLD may require anti-money laundering checks.

4. Contracts, Registration & Transfer

The documents you need include:

  • Memorandum of Understanding (MoU) or Sales and Purchase Agreement (SPA)
  • No Objection Certificate (NOC) from the developer
  • Registration with the Dubai Land Department (DLD)
  • Title deed issued by DLD to confirm ownership

5. Visa / Residency via Property Ownership

To qualify for a 2-year Property Investor Visa when buying as a UK citizen, you need to meet criteria including a minimum investment threshold in Dubai property. The rules for 5- or 10-year Golden Visas are similar but carry a higher property investment threshold.

What key fees, taxes & thresholds do I need to know about?

As well as mortgage registration, valuation and bank fees, foreigners buying property in Dubai should budget for the transfer and registration fee to DLD to register ownership transfer, No Objection Certificates (NOC), community and developer fees. There are also annual costs for service charges and maintenance – these can be higher for waterfront properties.
